Before Meeting With a Patent Attorney - Ask These Questions

The questions you should ask yourself before talking with a patent attorney

Below are questions you should ask yourself - and answer - to get the most out of meeting with a patent attorney for the first time:

1. Determine who will own the patent.

Will you as the individual own the patent?
Or, will a business you run – or plan to form – own the patent?

2. Determine how you plan to use the invention.

Do you plan to make, market, and sell the technology you're patenting?
Or, do you plan to patent the technology and license it to a company?

3. Determine the timeline of how you plan to use the invention.

Do you need to sell the technology within the next year?
Do you need to tell investors about your technology?

4. Determine who the inventors are.

Did you - and you only - invent the invention?
Or, did other people help you invent the invention?

5. Determine your budget.

Do you have a certain dollar amount that will be too much to spend in order to obtain a patent?

6. Determine all the parts of your invention.

What is each part - or element - of your invention?
What variations of your invention can exist – or different versions of your invention?
If your invention is a physical object what material – or different types of material – will form each part?

7. Determine if other similar inventions exist.

Have you seen another technology which is similar to your invention?
If you have seen something similar, what are the similarities and differences between your invention and the similar technology?

Your first meeting with a patent attorney will be more valuable to you, by answering these questions

Once you have asked yourself these questions – and ideally answered these questions – you will be able to more effectively engage with your patent attorney and get more out of your first interaction with your patent attorney and eventually that working relationship.
