How to Properly Maintain Your Trademark
If proper maintenance documents and fees are not submitted at the proper time, a trademark registration will expire or be cancelled.
A summary of maintenance of a domestic federal trademark registration is as follows:
Required Maintenance
- Between the 5th and 6th year after the registration date: Section 8 Declaration - $225 per class
- Between the 9th and 10th year after the registration date: Section 8 Declaration ($225 per class) and Section 9 Declaration ($300 per class)
- Between the 19th and 20th year (29th and 30th year …): Section 8 Declaration ($225 per class) and Section 9 Declaration ($300 per class)
- Grace Period: Section 8 and Section 9 declarations will be accepted up to 6 months after the normal deadlines with an additional fee (Section 8 Declaration $100 per class and Section 9 Declaration $100 per class)
Optional Maintenance (Recommended)
- Section 15 Declaration - $200 per class
