US Patents and US Patent Applications listed on an IDS form shows the patent or publication number, the patent’s kind code, the issue or publication date, the name of the inventor of the patent, and notations that show where information relevant to patentability is found, where the notations can be page numbers, column numbers, or line numbers.
Normally, copies of the US Patents and US Patent Applications do not have to be submitted with the IDS form.
Foreign patent documents listed on an IDS contains a foreign document number, a country code, a kind code, a publication date, the name of the inventor of the patent, and notations which show where information relevant to patentability is found, where the notations can be page numbers, column numbers, and line numbers.
A copy of the foreign patent document should be submitted with an IDS form. MPEP 609.04(a)(II)
If the original foreign patent document is not written in English, an English translation of the patent document should be submitted if available. MPEP 609.04(a)(III); 37 CFR 1.98(a)(3)(ii). A translation can be acquired from Escapenet. A concise statement of the relevant portion of the foreign language patent document is required. A complete translation (which includes machine generated translations) of the non-English language information can replace the need for a concise explanation of the relevance of the content of the non-English reference. MPEP 609.04(a)(III)
Any non-patent source relevant for patentability should have a basic list of information included within the final section of an IDS form. The relevant information for non-patent sources includes the following items: name of the author (in capital letters), title of the article (if appropriate), title of the item, date of the Article, any page numbers associated with information related to patentability, any relevant volume-issue numbers, publisher of the article, and the city or country the article was published in. Similar to any foreign patent documents, a copy of the article or webpage must also be submitted with the IDS form. MPEP 609.04(a)(II)
